Pearl River County: Mississippi Power Transmission Line

Smith Phillips represented two separate landowners impacted by the acquisition of 125-foot-wide easements by Mississippi Power Company. The easements were acquired to construct a 230 KV overhead electric transmission line. Plans for the transmission line called for use of large H-frame poles, approximately one hundred feet tall. The easement for the transmission line bisected both properties and ran near the primary residence on each property. Mississippi Power's appraiser took the position that there was no damage to the value of the property outside the easement caused by the location of the transmission line. The landowners and their appraisers strongly disagreed.

The combined initial offers made to the property owners was $80,935.00. After completion of discovery, both cases settled at mediation before trial. The total compensation paid to the two landowners was $1,370,000.00.
